The Grammy-winning award pop singer, Mariah Carey, 36, has threatened legal action against porn star and failed politian Mary Carey, 26, to stop her trademarking her similar-sounding stage name. The singer is worried fans might confuse the two performers if Mary Carey’s application to trademark her name for audio and video recordings is successful. However, the porn star - real name Mary Cook - insists she’s not intimidated by Mariah Carey.

She said, “I’m ready to battle Mariah over this because I’ve been Mary Carey for a long time. It’s kind of funny because I’m a porn star and I’ve been being myself for a long time. I think she’s being silly.” Meanwhile Ms Cook’s lawyer David Beitchman insists the singer stands little chance of winning a court battle over the names.
“My first thought was, does Mariah Carey realise what her lawyer is comparing her to and are they seriously concerned?Do they seriously think the fans are going to be confused?”.

According to Reuters, in October, a lawyer for the “We Belong Together” singer, Mariah Carey, sent Mary Carey’s representatives a letter threatening legal action if she did not withdraw the application.
“MARY CAREY and MARIAH CAREY share the identical surname and have first names that are very similar,” attorney Robert Becker wrote. And in part because the porn star was seeking the trademark for audio and video recordings, he said, “Confusion between your client and her MARY CAREY trademark and our client and its MARIAH CAREY trademark is therefore likely.”

Becker also demanded that Mary Carey use her name only for “adult entertainment” and that she not sing or perform music.
“This is a technical procedure to stop a trademark registration. Mariah Carey has no affiliation with Mary Carey,” said Mariah Carey’s spokeswoman, Leslie Sloane-Zelnik.

The Porn star Carey is best known for her lesbian themed films. In addition to numerous porno movies, she has posed in adult magazines and has appeared in adult TV shows such as Totally Busted, Sexy Urban Legends on Playboy TV, and started using the stage name Mary Carey in 2002 and applied for the trademark this year. Mary Carey also became the first active porn star to campaign for a high office in the US Government when she ran for Governor of California in 2003 - against other “political luminaries” such as Arnold Schwarzenegger and Gary Coleman. She finished in the top 10 with over 10,000 votes.

Mariah Carey has been labeled by most as a person who can’t act. Her songs and her acting “career” were plagued by accusations that she’s incapable of conveying emotions. Her singing is technically super-human, but… New York Daily News wrote that Carey’s singing “is ultimately what does her in. For Carey, vocalizing is all about the performance, not the emotions that inspired it … Does having a great voice automatically make you a great singer? Hardly.” Similarly, her acting career was a flop. Carey’s first starring role was in Glitter (2001), a film which has consistently been ranked as one of the worst of all time in user voting on IMDB. But she had a major comeback with last year’s “The Emancipation of Mimi,” the best-selling pop album of 2005. She won a Grammy for the single “We Belong Together.”
